Agreement
By signing up as an Affiliate in the First Choice Affiliate Program (“Program”), you agree to actively promote and sell First Choice SEO products and services and to be bound by the following Terms of Service.
This is a performance-based sales program. While we provide tracking links and marketing tools, Affiliates are expected to take an active role in generating new business. First Choice reserves the right to update these Terms at any time. Continued participation after changes constitutes acceptance.
Violation of these terms may result in account termination and forfeiture of commissions earned during the period of violation.
Account Terms
- You must be 18 years or older.
- Automated signups (bots/scripts) are prohibited.
- Accurate personal and contact information is required.
- Each account is for individual use only.
- Affiliates are responsible for their own account security.
- Multiple accounts per person or entity are not allowed.
- You may not earn commissions on your own purchases or licenses.
- Compliance with all relevant local, state, and federal laws is required.
- Unethical or deceptive sales tactics will lead to termination.
Promotional Tools & Special Links
You’ll receive a unique Affiliate Code and access to marketing assets. Only provided links and formats should be used to ensure proper sales tracking.
Affiliates must use the Special Links exactly as provided. We are not responsible for lost commissions due to misused or altered tracking formats.
Sales Attribution – “First Cookie Wins”
We follow a “first cookie wins” attribution model. The first Affiliate to introduce a customer via a tracked link receives commission credit. Cookies last 120 days.
Commission Structure & Payment
- Tier 1 (Direct Sales and Upgrades): 35% of the pre-tax sale and all recurring monthly revenue.
- Tier 2: 30% of Tier 1’s commission.
- Tier 3: 15% of Tier 1’s commission.
Payouts:
- Minimum payout threshold is $100.
- Payments are made twice monthly — on the 1st and 15th — via PayPal.
- Commissions are paid only on confirmed, tracked sales.
Training & Sales Support
Affiliates receive ongoing access to our training library, sales guides, webinars, and support team. Active engagement is encouraged to improve results and long-term success.
Identifying as a First Choice Affiliate
Affiliates may identify themselves as a “First Choice Affiliate” in public communications. However:
- You may not imply you are an employee, manager, or agent of First Choice.
- Press releases, formal claims, or misrepresenting your role are not allowed.
- Affiliates must accurately describe their status and relationship to the company.
Payment Schedule
As long as your commission balance exceeds $100, payments are sent via PayPal or another approved method on the 1st and 15th of each month. If you have not reached this threshold, commissions roll over until you do.
Customer Relationship
Customers acquired through the Program are customers of First Choice. We manage all customer service, billing, and policy decisions. Pricing and availability are subject to change at any time.
Your Responsibilities
Affiliates are fully responsible for:
- Ensuring Special Links are used correctly.Ethical marketing and accurate representation of services.
- Maintaining compliance with platform rules (e.g., Meta, YouTube, etc.).
- Ensuring all promotional content is lawful and truthful.
- Clearly disclosing how data is collected (if applicable).
Compliance with Laws
Affiliates must comply with all applicable marketing, privacy, and anti-spam laws, including the CAN-SPAM Act. Email spamming, deceptive offers, and illegal marketing will result in termination.
Minimum Performance Requirement
To maintain eligibility for recurring monthly commissions, Affiliates must close at least one new direct sale every six (6) months. If no new sale is made within this time:
- Your Affiliate account will be marked as inactive.
- All future recurring commissions from previous sales will be permanently forfeited.
- You may reapply or reactivate by making a new sale, but forfeited commissions will not be restored.
This policy ensures active participation in the sales program.
Termination & Inactivity
Either party may terminate this agreement at any time. Upon termination:
- You must remove all promotional materials and links.
- Final commissions above $100 will be paid (unless earned through fraud).
- First Choice reserves the right to deactivate inactive accounts after 6 months of no new sales.
Relationship of Parties
You are an independent contractor. This agreement does not create a partnership, franchise, or employment relationship. You cannot make claims or commitments on behalf of First Choice.
Limitations of Liability
We are not liable for indirect damages, lost profits, or tracking errors. Our total liability is limited to the commissions you’ve earned under this agreement.
Disclaimers
We do not guarantee uninterrupted access to the Program or its features. Tools are provided as-is.
Arbitration
Any dispute will be resolved via binding arbitration under the American Arbitration Association. IP-related issues may be pursued in court.
Miscellaneous
This agreement is governed by U.S. law. It may not be transferred without permission. Failure to enforce any part does not waive our rights. This document supersedes all prior versions.
